These Terms and Conditions ("Terms") constitute a legally binding agreement governing your access to and use of the PH9 digital platform, including the PH9 mobile application distributed via the Apple App Store and Google Play Store, and all related websites, landing pages, and services (collectively, the "Platform").
For mobile application distribution purposes, the Platform is published by POWERHOUSE9JA LLC, a company registered in the United States ("Publisher," "we," "us," or "our").
By accessing, registering for, purchasing participation tickets on, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and the PH9 Privacy Policy. If you do not agree, you must not use the Platform.
PH9 is a digital participation and engagement platform designed primarily for individuals of Nigerian origin including those residing internationally.
- POWERHOUSE9JA LLC acts solely as the App Store and Play Store publisher and technical platform facilitator.
- Certain participation frameworks, engagement mechanics, draw processes, verification procedures, and reward administration activities may be operated by affiliated entities or partners located outside the United States.
- The Publisher does not operate gambling, betting, lottery, or wagering services within the United States.
- PH9 is not a financial institution and does not provide banking services, stored-value accounts, investment products, or financial advice.
Participation on the Platform:
- Is voluntary and digital in nature;
- Is ticket-based and access-driven;
- Does not involve wagering, betting, staking, or risk of financial loss;
- PH9 is not a financial institution and does not provide banking services, stored-value accounts, investment products, or financial advice.
- Does not provide cash prizes, monetary payouts, or financial returns.
Digital participation tickets grant access to Platform participation experiences only. Tickets do not represent money, stored value, securities, or financial instruments and have no intrinsic or redeemable monetary value.
To access or use the Platform, you must:
- Be at least eighteen (18) years old.
- Possess the legal capacity to enter binding agreements.
- Use the Platform in compliance with all applicable laws and regulations.
Participation may be restricted or unavailable in jurisdictions where prohibited by law. Employees, contractors, agents, or affiliates involved in Platform administration, verification, or reward fulfillment may be restricted or prohibited from participation.
Certain features of the Platform require account registration. You agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your account information as necessary;
- Safeguard your login credentials and prevent unauthorized access;
- Accept full responsibility for all activities conducted through your account.
PH9 reserves the right to suspend or terminate accounts containing false, misleading, incomplete, or outdated information.
- Participation tickets may be obtained exclusively through authorized digital payment channels integrated into the Platform, including in-app purchases where applicable.
- Each ticket grants one (1) entry into a specific participation event or experience.
- Tickets are non-transferable, non-refundable, non-exchangeable, and have no cash value.
- Unauthorized resale, assignment, or transfer of tickets is strictly prohibited.
PH9 reserves the right to cancel, revoke, or invalidate tickets obtained through fraud, abuse, system manipulation, or violation of these Terms.
- Participant selection is conducted using controlled, system-based mechanisms intended to promote fairness and platform integrity.
- Any rewards offered are non-cash, pre-declared, and non-redeemable for money.
- PH9 reserves the right to substitute rewards with alternatives of comparable nature or value.
- All selections are final, subject to eligibility verification and compliance with these Terms.
Selected participants may be required to:
- Confirm identity;
- Submit verification documentation;
- Complete validation procedures within specified timeframes.
Failure to complete verification, provide accurate documentation, or comply with Platform requirements may result in disqualification or forfeiture of participation rewards.
You may use the Platform solely for lawful purposes and in strict accordance with these Terms. You agree not to:
- Violate any applicable local, national, or international law or regulation;
- Attempt to manipulate, exploit, or interfere with participation mechanics, selection systems, verification processes, or reward administration;
- Provide false, misleading, or fraudulent information;
- Impersonate PH9, the Publisher, affiliated operators, staff, or other users;
- Engage in abusive, deceptive, harassing, or harmful conduct;
- Use bots, scripts, scraping tools, or automated systems to access or interact with the Platform;
- Introduce malware, malicious code, or attempt unauthorized access to Platform infrastructure;
- Interfere with the availability, performance, or security of the Platform;
- Use the Platform for unauthorized commercial solicitation or advertising;
- Engage in conduct that exposes PH9 or its affiliates to legal, regulatory, or reputational risk.
Violations may result in immediate suspension, forfeiture of participation rights, or permanent termination without notice.
All Platform content, software, trademarks, logos, designs, and materials are owned by or licensed to PH9 and are protected by applicable intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes only.
Personal data is collected, processed, and protected in accordance with the PH9 Privacy Policy, which forms an integral part of these Terms. Data may be used for account management, verification, fraud prevention, platform security, and legal compliance. The Publisher does not sell or rent personal data.

Ticket Purchases
All digital participation tickets purchased through the Platform are final, non-transferable, and non-refundable, except where refunds are expressly required or permitted by the applicable app marketplace or by law.
App Store and Play Store Refunds
For purchases of participation tickets made through the Apple App Store or Google Play Store, all refund requests must be submitted directly to the respective platform and are governed solely by their refund policies. PH9 does not independently process or issue refunds for ticket purchases made through app marketplaces.
Wallet Funding and Withdrawals
- Wallet funds may be added through authorized third-party payment processors, including Paystack, where available.
- Wallet balances represent user-owned funds that have not been converted into participation tickets.
- Eligible wallet balances may be withdrawn in accordance with Platform rules and applicable payment processor requirements.
- Wallet withdrawals are not refunds and do not apply to ticket purchases already completed.
- Once wallet funds are used to obtain a participation ticket, such funds are irrevocably converted into participation access and are no longer withdrawable.
Participation tickets do not represent money, stored value, cash equivalents, or financial instruments. PH9 does not operate as a financial institution or money services business.
The Platform may integrate or link to third-party services. PH9 does not control and is not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PH9 disclaims all warranties, express or implied, including accuracy, availability, and fitness for a particular purpose.
To the maximum extent permitted by applicable law, POWERHOUSE9JA LLC, its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to damages for loss of profits, loss of data, business interruption, loss of goodwill, or other intangible losses, arising out of or related to your access to or use of the Platform.
Without limiting the foregoing, PH9 shall not be liable for damages resulting from:
- Technical interruptions or system failures
- Platform downtime or unavailability
- Errors or omissions arising from inaccurate or incomplete user-provided information
- Failures, delays, or disruptions caused by third-party services, payment processors, app marketplaces, or network providers
In all cases, PH9’s total aggregate liability for any claim arising out of or relating to the Platform shall not exceed the total amount paid by you (if any) to PH9 in the twelve (12) months preceding the event giving rise to the claim.
PH9 reserves the right to suspend or terminate access to the Platform at any time for legal, security, compliance, or operational reasons.
These Terms shall be governed by and construed in accordance with the laws of the State of [Applicable U.S. State], without regard to conflict-of-law principles.
PH9 may amend these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
